These Terms & Conditions (“Terms”) govern your use of the website of Swipetrend Private Limited (“Swipetrend”, “we”, “us”, “our”) and any enquiries, quotations, purchases, services, or support you request from us. By using our website or placing an order with us, you agree to these Terms.

Acceptance of Terms
By accessing our website or engaging us for any service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use our website or services.

Scope of Services
We provide supply (where applicable), installation, commissioning, and after-sales support for air-conditioning solutions, including split, window, cassette, ductable, light commercial, VRF systems, and controls/BMS integrations. The exact scope for your project will be specified in our quotation or invoice.

Quotations & Orders
• Quotations are typically valid for 15 days unless stated otherwise and are subject to site survey, drawings, and OEM availability.
• Your acceptance (purchase order, email confirmation, or advance payment) constitutes an order.
• Any variations (e.g., quantity changes, rerouting, height changes, civil modifications, access issues) will be quoted and charged as extras.

Prices, Taxes & Duties
• All prices are in INR unless stated otherwise. GST and applicable duties/charges are extra as per law.
• Freight, loading/unloading, hoisting, and special access equipment are chargeable if not explicitly included.

Payments
• Payment terms (e.g., advance, stage payments, balance before handover) are as mentioned in your quotation/invoice.
• Delay or default in payment may lead to suspension of work and/or late charges.
• Title to goods passes only on receipt of full payment. Risk transfers on delivery to site.

Scheduling, Access & Site Readiness
• You must provide clear site access, power, safe storage, and required permissions (e.g., society/landlord).
• Work schedules depend on site readiness and may be rescheduled for safety or coordination reasons.
• Delays due to site inaccessibility, incomplete civil/electrical work, or third-party dependencies may incur additional visits/charges.

Delivery, Risk & Title
• Delivery dates are estimates and depend on OEM/transport availability.
• Risk of damage or loss passes on delivery to site; title passes on full payment.

Installation Standards & Handover
• Installations follow manufacturer guidelines and industry norms.
• Post-install testing/commissioning and a brief demonstration are part of handover.
• Any civil work (cutting, core drilling, false ceiling, plaster/paint touch-ups) is excluded unless explicitly included.

Warranty
• OEM equipment warranty is governed by the manufacturer’s policy supplied with the product.
• Workmanship warranty, if offered, will be as stated on your invoice. It excludes damage due to misuse, civil leakage, electrical faults, pests/rodents, unauthorized modifications, or lack of maintenance.
• Filters/consumables, gas top-ups due to external leaks, and normal wear-and-tear are not covered unless expressly included.

After-Sales Support & AMC
• Corrective service is attended as per queue and technician availability.
• Preventive maintenance and extended coverage are available under separate AMC agreements with their own terms.

Customer Responsibilities
• Provide accurate site information, drawings/approvals, and a safe working environment.
• Ensure civil/electrical readiness, sleeves/ducts, scaffolding, and structural supports as required (unless included in our scope).
• Protect equipment at site from theft, damage, or weather exposure.

Cancellations & Returns
• Orders for custom or specially-procured items are non-cancellable and non-returnable.
• Service cancellations after scheduling may attract visit/cancellation charges and recovery of actual costs.

Website Use
• Website content (text, images, brochures) is for general information. Product features/specifications are owned by the respective OEMs and may change without notice.
• You may use the site for personal, non-commercial purposes. Unauthorized copying, scraping, or misuse is prohibited.

Intellectual Property
All trademarks, logos, and materials displayed are the property of their respective owners. No rights are granted except as expressly stated in these Terms.

Third-Party Links & Tools
We may link to third-party websites or use third-party tools. We are not responsible for their content, policies, or availability.

Limitation of Liability
• To the maximum extent permitted by law, we are not liable for indirect, incidental, special, or consequential damages.
• Our total aggregate liability for any claim is limited to the amount you paid to us for the specific service/equipment giving rise to the claim.

Indemnity
You agree to indemnify and hold us harmless from claims, losses, or damages arising from your breach of these Terms or misuse of the services.

Force Majeure
We are not responsible for delays or failures caused by events beyond our reasonable control (e.g., extreme weather, floods, strikes, pandemics, supply chain disruptions).

Privacy
Your data is handled as described in our Privacy Policy. By using our website/services, you consent to such processing.

Governing Law & Jurisdiction
These Terms are governed by the laws of India. Courts at Patna, Bihar shall have exclusive jurisdiction, subject to applicable dispute-resolution laws.

Changes to Terms
We may update these Terms from time to time. Continued use of our website or services after an update constitutes acceptance of the revised Terms.
